Movement Medicine Physical Therapy, LLC - Privacy Policy

Movement Medicine Physical Therapy, LLC (“MMPT,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information of athletes, parents, coaches, and other users of the Movement Medicine Player/Coach Dashboard (the “Dashboard”) and related performance assessment services. This Privacy Policy explains how we collect, use, store, and disclose information when individuals participate in physical performance assessments conducted by MMPT or access the Dashboard.
1. Information We Collect. We may collect the following categories of information:
A. Personal Information. Information that identifies an individual athlete or user, including: Name, Date of Birth, Age, Email Address, Contact Information, Parent, legal guardian, or coach contact information, Team affiliation, and position(s) played. For minor athletes, information may be provided by a parent, legal guardian, or coach.
B. Performance Data. MMPT conducts biomechanical and athletic performance testing. This testing may generate performance data including: Force production measurements, Isometric strength metrics, Mobility and Range-of-motion measurements, Motion capture files (2D or 3D), Video recordings of athletic movement, Throwing analysis data, Biomechanical metrics, Comparative percentile rankings, and Readiness classifications, Performance scores and analytics (collectively, “Performance Data”).
C. Dashboard Usage Information. When users access the Dashboard, we may collect limited technical information such as: Login activity, Account usage, Device or browser information, and Interaction with Dashboard features. This information helps us maintain system security and improve the Dashboard.
D. Participant Entered Information. We collect information that athletes, parents, legal guardians, coaches, or other authorized users enter into the Dashboard.
2. How We Use Information. MMPT uses collected information for the following purposes:
A. Performance Assessment Services. To conduct athletic performance testing and generate performance analytics.
B. Dashboard Functionality. To provide athletes, parents, and coaches with access to assessment results and analytics.
C. Athlete Monitoring and Reporting. To generate performance reports, readiness classifications, and comparative analytics.
D. Research and System Development. We may use de-identified and aggregated data for research, system development, validation of performance models, education, and development of future services. No personally identifiable information will be used for marketing or promotional purposes. (For purposes of this Policy, “de-identified” information means data that has been processed to remove or obscure personal identifiers such that it cannot reasonably be used to identify an individual).
E. Operational and Administrative Purposes. To maintain records, communicate with athletes, coaches and parents, manage accounts, and to operate, secure, and improve system reliability and performance.
3. Sharing of Information. MMPT does not sell personal information. Information may be shared in the following circumstances.
A. With Authorized Users. Performance Data may be shared with the athlete, the athlete’s parent or legal guardian, authorized coaches associated with the athlete’s team, and staff of MMPT.
B. With Technology Providers. MMPT may share information with service providers that process information on MMPT’s behalf to support hosting, infrastructure, analytics, platform operation, and security. MMPT requires such providers to use information only as necessary to provide services to MMPT, subject to applicable contractual and legal restrictions. Where appropriate, MMPT may also provide de-identified or aggregated information for analytics, validation, research, or system improvement purposes.
C. With Collaborating Organizations. If an assessment is conducted in collaboration with another sports training organization, Performance Data may be shared with that organization for athlete development purposes. Currently MMPT collaborates with Maven Baseball Lab (“Maven”) and The Hill with respect to certain athletes and in those instances data will be shared with Maven, The Hill, and its personnel.
D. As Required by Law. MMPT may disclose information if required by: Court order, Legal process, Government request, or Protection of legal rights.
4. Access and Sharing. Access is controlled by role-based permissions as follows: (a) Players can access their own assigned Dashboard data, (b) Parents of Players can access their child’s Dashboard data; (c) Coaches can access Dashboard data for players on their team; and (d) Our employees and administrators can access all data in the Dashboard and all assessments. (See Section 9 for additional information regarding minors’ data and access rights.) Access to the information on the Dashboard will be limited to the applicable athlete, his or her parents, and, if a team account has been established, the player’s coach, so long as a valid agreement for such services is in place with MMPT and has not expired or terminated. MMPT may retain Performance Data for internal and research purposes, but user access to the Dashboard may terminate upon expiration of the applicable service agreement.
5. Third-Party Platforms. The Dashboard may interact with third-party platforms or technologies. Use of third-party platforms is subject to the privacy policies and terms of those platforms, and MMPT does not control and is not responsible for their privacy or data practices.
6. Biometric and Motion Capture Data. MMPT may use motion capture systems, force plate technology, and other biomechanical measurement tools that analyze body movement, force production, and physical performance characteristics. These technologies may generate measurements relating to an athlete’s physical movements, body mechanics, and performance characteristics. Such information may be considered biometric or biomechanical data under certain laws. The Dashboard and related Performance Data services are intended for performance assessment and training purposes, not for medical diagnosis or treatment. To the extent MMPT provides separate healthcare or clinical services, those services may be subject to different privacy practices or legal requirements, but with respect to the Dashboard and Performance Data MMPT is not a healthcare provider or a ‘covered entity’ under the Health Insurance Portability and Accountability Act. Information collected through the Dashboard is used for performance and training purposes and is not intended to constitute medical diagnosis or treatment.
Such information may be shared with users, their parents or legal guardians and/or their coaches. We collect and use such data solely for athletic performance assessment, biomechanical analysis, generation of reports, athlete monitoring and development, and research and system development using de-identified data. MMPT does not sell, lease, trade, or otherwise profit from biometric data or motion capture data. Biometric or biomechanical information collected during performance assessments is stored securely. Subject to applicable law, MMPT will honor requests by an authorized user or parent/legal guardian to delete identifiable biometric or biomechanical information where deletion is legally and operationally feasible. MMPT may retain de-identified or aggregated information, and deletion may also be limited by applicable law, contractual requirements, recordkeeping obligations, security needs, or third-party platform limitations.
7. Data Retention. Except as otherwise stated for biometric or biomechanical information in Section 6, MMPT retains personal information and Performance Data for as long as reasonably necessary to provide services, maintain accounts, support athlete progress tracking and historical comparison, comply with contractual and legal obligations, protect system integrity and security, resolve disputes, and support internal analytics, research, and system improvement. Retention periods may vary depending on the nature of the information, whether the data has been de-identified, and applicable legal requirements.
8. Data Accuracy; Protection of Information. MMPT implements reasonable administrative and technical safeguards designed to protect personal information from unauthorized access, disclosure, or misuse. These safeguards may include secure servers, encrypted data transmission, restricted system access, and role-based permission controls. However, no electronic system can guarantee absolute security.
9. Information Regarding Minors; Authorized Submission and Access. MMPT is committed to complying with applicable laws governing the collection of information from minors, including the Children’s Online Privacy Protection Act (COPPA), where applicable. Many athletes who use MMPT’s services are minors. Information regarding a minor athlete may be submitted only by: (a) the athlete’s parent or legal guardian; (b) an authorized representative of a team, school, club, league, or other organization that has engaged MMPT’s services for the athlete and has authority to provide such information; or (c) a coach or other adult expressly authorized by the athlete’s parent or legal guardian, or by the applicable team or organization, to provide information in connection with MMPT’s services.
Where required by MMPT or applicable law, MMPT will obtain consent from a parent or legal guardian before collecting, using, or disclosing a minor athlete’s personal information or Performance Data through the Dashboard or related assessment services. Such authorization may be obtained through registration materials, written consent forms, electronic acknowledgments, service agreements, team enrollment materials, or other consent mechanisms MMPT deems reasonably appropriate. MMPT may rely on such authorization unless MMPT has actual notice that the authorization is invalid, withdrawn, or has expired.
Coaches and other authorized representatives of a team, club, league, or organization may create athlete profiles, submit athlete-related information, and access Dashboard data only to the extent authorized by MMPT and any permissions or consents obtained from the athlete’s parent or legal guardian or from the athlete if legally authorized to consent. Coach and team access is limited to athletes associated with that coach’s or organization’s authorized roster or account and only for so long as the applicable authorization and service relationship remain in effect.
If MMPT provides services in connection with a team, school, club, league, training organization, or similar entity, that entity may provide athlete information to MMPT and may authorize access to Dashboard information for its designated coaches, administrators, and personnel to the extent permitted by applicable law and the entity’s agreement with MMPT. MMPT may rely on representations from the applicable organization that it has obtained any required permissions, notices, or consents from athletes and/or their parents or legal guardian. However, MMPT reserves the right to require separate parental or athlete consent where MMPT determines such consent is appropriate or legally required.
When an athlete who previously participated as a minor reaches the age of majority under applicable law, MMPT may thereafter treat that individual as the person authorized to control his or her account, personal information, and Dashboard access rights, except to the extent continued parent, legal guardian, coach, or organizational access is otherwise authorized by the athlete, required by law, or permitted under an applicable service arrangement. MMPT may require the now-adult athlete to update account information, confirm permissions, or execute new consents before modifying existing access rights.
Subject to applicable law, a parent or legal guardian may request access to, correction of, or deletion of a minor athlete’s personal information, and may request withdrawal of previously provided consent for MMPT’s future collection, use, or disclosure of the minor’s information. MMPT may take reasonable steps to verify the identity and authority of the requesting person before acting on any such request. Withdrawal of consent will not affect any collection, use, or disclosure that occurred before the request was received and processed. MMPT may retain information where permitted or required by law, contract, legitimate business needs, recordkeeping obligations, dispute resolution needs, research uses based on de-identified data, or platform integrity and security requirements.
10. User Rights. Subject to applicable law, users may request: Access to personal information, correction of inaccurate information, and/or Deletion of personal information. Requests may be submitted to: eric@mmptperformance.com. MMPT may take reasonable steps to verify the identity of any individual submitting a request and will respond within a reasonable timeframe consistent with applicable law. Some information may be retained where necessary for legitimate business purposes, and MMPT may limit or deny such requests where necessary to protect another person’s rights, comply with rights under applicable legal or contractual obligations, and/or to preserve de-identified information.
11. Changes to This Policy. MMPT may update this Privacy Policy from time to time. The updated version will be posted with a revised effective date. Where required by applicable law, MMPT will provide additional notice or obtain consent for material changes.
12. Related Agreements. This Privacy Notice works alongside, and does not replace MMPT’s Assumption of Risk, Release of Liability, Indemnification, Covenant not to Sue Agreement and Terms of Use Agreement.
